Description: 

During the Supreme Court's recent consideration of United States v. Vaello Madero, Justice Neil Gorsuch asked "Why shouldn't we just admit the Insular Cases were incorrectly decided?" This follows the Supreme Court's 2020 decision in FOMB v. Aurelius where the Justices expressly passed on the opportunity to overrule the Insular Cases. At the same time, in Fitisemanu v. United States the U.S. Justice Department continues to rely on the Insular Cases to deny recognition of a constitutional right to citizenship for people born in U.S. territories. As the Supreme Court, Congress, and the White House consider the future of the Insular Cases, what can and should this mean for broader conversations about the relationship between the United States, Guam, and other Territories?
